When you visit, use, or navigate our Services, we may process personal information depending on how you interact with our Services, the choices you make, and the products and features you use. 

According to Termly, your thoughts and opinions are considered philosophical beliefs, which are sensitive personal information. Learn more about sensitive personal information and personal information. 

Nivationist ONLY purposefully collects the following 3 types of information:

1. Your first and last name (non-sensitive)

2. Your email address (non-sensitive)

3. Your philosophical beliefs (sensitive): Nivationist may collect your comments, feedback, and opinions from all communications associated with Nivationist. We reference them anonymously for educational purposes on creating content relating to productivity, mindset, 3D, and digital marketing if they’re sent to Nivationist in private. If we do need to identify you to the public, for example, testimonials, we will get explicit consent from you before publishing your thoughts/opinions. For contributions (i.e. online comments) that are already shown in public, we reserve the right to use your information for educational/demonstration purposes along with your public identifier. The above types of personal information will only be collected when you sign up for a newsletter, when you use the contact forms, when you email me, when you submit a comment, and other future scenarios when the practice is commonplace and at your discretion. We may also process sensitive personal information when necessary with your consent or otherwise permitted by applicable law in order to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, to comply with the law, and other legal reasons. See “WHAT INFORMATION DO WE COLLECT?” below to know the third-parties we use to process the data we purposefully collect and store and other personal information that are automatically collected by the third-parties.

According to Termly, using publicly available information and data sources, such as industry reports, about users similar to our audience is considered receiving collected information from third parties. 

Thus, we DO receive information from third parties because we need to do research to support the claims we made in our content, especially on blog topics pertaining to digital marketing. 

We may share personal information under specific situations and with specific categories of third parties that are applicable under the law. See the Table of Contents below for the type of personal information we collect.

What information do we collect?

Personal Information You Disclose to Us

We collect personal information that you provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or when you contact us.

Personal Information: The personal information we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

All personal information that you provide to us must be true, complete, and accurate. You must notify us of any changes to such personal information. 

Sensitive Information: We may collect sensitive information about your thoughts, opinions, and other philosophical beliefs you may have. 

Methods of Collection and Processes

You disclose your personal information directly to us in 2 ways. 

  1. Newsletter Sign-Up Forms: We use MailerLitewhich is a GDPR Compliant newsletter creation and signup service. See their privacy document. We only collect your first/last name and email address so we can send you email newsletters (your continent may also be collected). We reserve the right to contact you for other legitimate reasons and interests (i.e. privacy updates, asking for your consent).   2. Message Contact Forms: We use Elementor, which is a GDPR Compliant website builder. See their privacy document. We only collect your first/last name, email addresses, and your message so we can get back to you using Gmail, a GDPR Compliant emailing service from Google. See how Gmail keeps your data secure. If you have a data privacy request (i.e. a copy of your personal information), we will use Google Drive and Dropbox, which are cloud document creation/processing services to process your requests. See Dropbox’s GDPR Compliance Statement. Nivationist may store your messages for educational purposes and reference them anonymously for writing content and creating newsletters. Your information may be stored in Notion (see their GDPR Compliant page) and Obsidian, which are two knowledge-base and note-taking systems we use for creating content. As checked on 2/7/24, Obsidian isn’t GDPR compliant because they don’t have a EU representative. However, Obsidian have a strong encryption data system and they claim to not be able to see the stored content on their end. See Obsidian’s privacy policy.

 

Information Automatically Collected

Some information, such as your Internet Protocol (IP) address and/or browser and device characteristics is collected automatically when you visit our Services. 

We automatically collect certain information when you visit, use or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:

  1. Log and Usage Data: This type of data contains performance information of the Service and is automatically collected by our servers for diagnostic purposes when we record the log files after you access or use our Services. Depending on how you interact with us, this log data may include your IP address, device information, browser type, settings/information about your activity in the Services, (i.e. date/time stamps associated with your usage, pages/files viewed, searches, features you used, and other actions you take), device event information (i.e. system activity, error reports, crash dumps), and hardware settings.
  2.  Device Data: We collect device data such as information about your computer, tablet, phone, or other device you use to access the Service. Depending on the device used, the device data collected may include your IP address, proxy server, device, application identification numbers, location, browser type, hardware model, internet service provider (ISP) and/or mobile carrier, operating system, and system configuration information.
  3. Location Data: We collect location data such as your device’s location (city, state, country, or continent). The amount of information we collect depends on your device’s type and settings you use to access the Services. You prevent us from collecting this information by disabling your Location setting on your device or using other methods to refuse us from accessing this information. However, you may not be able to use certain aspects of the Services if you choose to opt out. 

How do we process your information?

We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent. 

We process your personal information for a variety of reasons, depending on how you interact with our Services, including: 

  1. To deliver and facilitate delivery of Services to the user. We may process your information to provide you with the requested Service. 
  2. To produce and conduct research for content creation. We may process your information anonymously (if your information is sent to us in private) to be used in Nivationist (i.e. blogs, newsletters, videos, and other content) to create honest and helpful content for you.   3. To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve potential issues you might have with the requested service. 
  4. To send administrative information to you. We may process your information to send you details about our products and Services, changes to our terms and policies, and other similar information.
  5. To enable user-to-user communications. We may process your information if you choose to use any of our offerings that allow for communication with another user. 
  6. To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services. 
  7. To send you marketing and promotional communications. We may process the personal information you send to use for our marketing purposes, if this is in accordance with your marketing preferences. 
  8. To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve user experience. 
  9. To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are the most relevant to you.
  10. To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

What legal bases do we rely on to process your information?

We only process your personal information when we believe it is necessary and we have a valid legal basis to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

Consent. We may process your information if you have given us permission (i.e. consent) to use your personal information for a specific purpose. You can withdraw your consent at any time by clicking the unsubscribe button at the bottom of marketing and certain communication emails. 

Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.

Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:

  • Send users information about special offers and discounts on our products and services
  • Analyze how our Services are used so we can improve them to engage and retain users
  • Support our marketing activities
  • Understand how our users use our products and services so we can improve user experience and create better content
 

Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.

Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

We may process your information if you have given us specific permission (i.e. express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e. implied consent). You can withdraw your consent
at any time. In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  1. If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
  2. For investigations, fraud detection, and prevention
  3. For business transactions provided certain conditions are met
  4. If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
  5. For identifying injured, ill, or deceased persons and communicating with next of kin
  6. If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
  7. If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
  8. If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
  9. If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
  10. If the collection is solely for journalistic, artistic, or literary purposes
  11. If the information is publicly available and is specified by the regulations

Where and with whom do we share your personal information?

We may share information in specific situations described in this section and/or with the following categories of third parties. 

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work.

What is our stance on third party websites?

We are NOT responsible for the safety of any information that you share with third parties, that we may link to or advertise on our Services, that are not affiliated with our Services. 

The Services may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third parties. 

Any data collected by third parties is not covered by this privacy notice. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

Do we use cookies and other tracking technologies?

We may use cookies and other tracking technologies (like web beacons and pixels) to collect and store your information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Policy.

How do we protect your information?

Email Subscribers: We store your names and email addresses that we collect from our website in MailerLite, which is an email newsletter service we use to send content to our subscribers. See MailerLite’s promise on securing user data

Online Visitors: The communications between us and non-subscribers goes through the Google’s emailing service, Gmail. See Google’s promise on securing user data

Storing Philosophical Opinions: We may store your opinions (comment section of our websites, social media, email communications, and other communications between us) so we can use your opinions that are either previously submitted in private to be anonymously or identified (only after getting your consent) or available publicly with your public identifier to generate inspirations, use as supportive evidence, and other ways to create better content and improve user experience. Visit the “YOUR SUBMISSIONS AND CONTRIBUTIONS” section in Terms and Conditions for more details. To create a secured and streamlined system to create content, we may sync (using specialized code or third-party plugins) and store your opinions in an encrypted knowledge base and note-taking application called Obsidian or Notion. We will do our best to store and use your data securely by 

1.) backing up data regularly, 

2.) using multifactor authentication and strong passwords,

3.) use anti-virus and malware protection, and 

4.) remove all data, to the best of our ability, in old IT equipment before discarding. 

However, we are not liable for any loss or damages caused by the use of third-party services because we’re not responsible for the content, privacy, or security practices/policies of any third parties. It is your responsibility to look into the security and any legal policies of the third parties that we use before using our Services. 

How long do we keep your information?

We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business needs to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Do we collect information from minors?

NIVATIONIST complies with both the Children’s Online Privacy Protection Rule (COPPA) and the General Data Protection Regulation (GDPR)

COPPA: Users (under age 13) 

We DO NOT knowingly collect data from or market to children under 13 years of age.

According to the Federal Trade Commission (FTC), we’re may NOT be required to comply with the Children’s Online Privacy Protection Rule (COPPA) because

1.) we’re NOT directed to children under 13. The FTC defines “directed to children under 13” on several factors. For example, “subject matter of the site or service, visual and audio content, the use of animated characters or other child-oriented activities and incentives, the age of models, the presence of child celebrities or celebrities who appeal to kids, ads on the site or service that are directed to children, and other reliable evidence about the age of the actual or intended audience.” 

2.) We are directed to a general audience and DON’T have actual knowledge that we collect personal information from children under 13.

GDPR and age of “majority” rule: Users (age 13-18)

We do NOT knowingly collect data from or market to children under 18 years of age. 

By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will either ask for parental consent using the contact info provided by the minor or immediately deactivate the account and take reasonable measures to promptly delete such data from our records. What are your privacy rights?

In some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right 

(i) to request access and obtain a copy of your personal information, 

(ii) to request rectification or erasure; 

(iii) to restrict the processing of your personal information; 

(iv) if applicable, to data portability; and 

(v) not to be subject to automated decision-making.

We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent:
If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent. 

Opting out of marketing and promotional communications:
You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the General Questions Form at https://nivationist.com/contact/. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Cookies and similar technologies:
Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. You may also opt out of interest-based advertising by advertisers on our Services. Controls for do-not track features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

How do we use and share your personal information?

We collect and share your personal information through: Targeting cookies/Marketing cookies, Social media cookies, Beacons/Pixels/Tags, Click redirects: Affiliate links, social media plugins. 

We use social media features, such as a “Like” button, and widgets, such as a “Share” button, in our Services. Such features may process your Internet Protocol (IP) address and track which page you are visiting on our website. We may place a cookie to enable the feature to work correctly. If you are logged in on a certain social media platform and you interact with a widget or button belonging to that social media platform, this information may be recorded to your profile of such social media platform. To avoid this, you should log out from that social media platform before accessing or using the Services. Social media features and widgets may be hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy notices of the companies that provide them. By clicking on one of these buttons, you agree to the use of this plugin and consequently the transfer of personal information to the corresponding social media service. We have no control over the essence and extent of these transmitted data or their additional processing.

Will your information be shared with anyone else?

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. We have not sold or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months.

California Residents
California Civil Code Section 1798.83, also known as the “Shine The Light” law permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us via the General Questions Form at https://nivationist.com/contact/

If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us via the General Questions Form at https://nivationist.com/contact/ and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

CCPA Privacy Notice
This section applies only to California residents. Under the California Consumer Privacy Act (CCPA), you have the rights listed below.

The California Code of Regulations defines a “residents” as:
(1) every individual who is in the State of California for other than a temporary or transitory purpose and

Verification Process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.
